US to deploy THAAD in Republic of Korea - Constitutional Court rejects petition to ban deployment of anti-missile defense system

The United States and the Republic of Korea are one step closer to full deployment of the system

What is known

In February 2022, a group of 392 people appliedpetition to ban the deployment of the THAAD system in the country. The protesters believed that certain clauses in the Status of Forces Agreement were unconstitutional. However, this week the Constitutional Court rejected the petition, saying that it does not contain the prerequisites for a trial.

Anti-missile system deployment plandefense was approved on April 20, 2017. According to the document, the THAAD battery will be located on the territory that was previously used as a golf course. This decision sparked protests from some locals and anti-war activists.

Later in 2017, protesters filedan administrative lawsuit demanding that the Minister of Foreign Affairs cancel the grant of land. The lawsuit was dismissed by the local and appellate courts. Already in 2023, the Supreme Court declared that the case could not be the subject of an administrative proceeding.
