Native American tribe sues over SpaceX base

Sierra Club, Carrizo/Comecrudo Indian Tribe, and Save RGV

filed a class action lawsuit against the Texas General Land Office, the Texas Land Commissioner, and Cameron County in Texas for periodically closing Boca Chica Beach to SpaceX operations.

The controversial beach of Boca Chica is located near SpaceX's Starbase base, where it develops, buildsand tests its next-generation Starship spacecraft and performsStarbase is currently undergoing an environmental review with the Federal Aviation Administration before the company plans tolaunch it and the Super Heavy rocket on its debut orbital journey.

In 2013, according to a statement from the Sierra Club, the Texas legislature amended the Texas Open Beaches Act to allow space agencies to close access to beaches.Then in 2018, the club adds, SpaceX built a rocket complex 460 meters away fromBeach.

"The 2013 amendment of the law is contrary to the state constitution, which Texas voters amended in 2009 — by a majority of 77 percent — to guarantee the right to free and open access to public beaches," the Sierra Club said.

The club claims that in the first three months of 2022 the beach was closed for 8 days, and in 2021 for about 25 days.
