Moscow is now actively attracting quarantine violators under Article 6.3 of the Code of Administrative Offenses (CAO).

Administrative Code of the Russian Federation Article 6.3. Violation of legislation in the field of ensuring the sanitary and epidemiological well-being of the population

… entail the imposition of an administrative fine on citizens in the amountfrom fifteen thousand to forty thousandrubles; on officials —from fifty thousand to one hundred and fifty thousand rubles; for persons carrying out entrepreneurial activities without forming a legal entity, —from fifty thousand to one hundred fifty thousand rublesor administrative suspension of activities for up to ninety days; for legal entities —from two hundred thousand to five hundred thousand rublesor administrative suspension of activities for up to ninety days.

As you can see, the amount is considerable! Note that in Moscow, many residents have already been fined under this article:

  • the girl was given a fine of 15,000 rubles for being on the sports ground, which is located more than 100 meters from the house
  • a citizen with registration in the Moscow region was in the capital without a good reason — a fine of 15,000 rubles was issued
  • everyone who is more than 100 meters away from the house is also actively fined 15,000 rubles

And these are not isolated cases, they have been registeredofficially quite a lot already. Starting today, fines have begun to be issued even more actively in all cities. There are a lot of cases, so “don’t play with fire”!

How to avoid a fine?

Note that many lawyers are puzzled whyfined precisely under the article described above. After all, it essentially concerns those who are in individual quarantine, which is prescribed by order of a sanitary doctor. That is, it is relevant for those who, for example, came from abroad and are quarantined, but violate it. Keep this in mind if you have to give any arguments against it. Recently, another article was adopted in the Code of Administrative Offenses. It is she who is actively appealing now, I am punishing residents who leave their homes without a pass and violate the quarantine regime in Moscow, Nizhny Novgorod and other cities of Russia. The amount of the fine is already slightly less, but for some it can still be a blow to the family budget.

Code of Administrative Offenses of the Russian Federation Article 20.6.1. Failure to comply with the rules of conduct in case of an emergency or the threat of its occurrence (introduced by Federal Law of 01.04.2020 N 99-FZ)

1.Failure to comply with the rules of conduct when introducing a high alert regime in a territory where there is a threat of an emergency situation, or in an emergency zone, with the exception of cases provided for in Part 2 of Article 6.3 of this Code, entails a warning or the imposition of an administrative fine on citizens in the amountfrom one thousand to thirty thousand rubles; on officials —from ten thousand to fifty thousand rubles; for persons carrying out entrepreneurial activities without forming a legal entity, —from thirty thousand to fifty thousand rubles; for legal entities —from one hundred thousand to three hundred thousand rubles.

Please note that under this article an action (inaction), repeated commission of an administrative offense, which is described above, entails a new fine:

…for citizens in the amount offifteen thousand to fifty thousand rubles; on officials —from three hundred thousand to five hundred thousand rublesor disqualification for a period of one to three years; for persons carrying out entrepreneurial activities without forming a legal entity, —from five hundred thousand to one million rublesor administrative suspension of activities for up to ninety days; for legal entities —from five hundred thousand to one million rublesor administrative suspension of activities for up to ninety days.

As you can see, the amounts are considerable, therefore weWe strongly recommend that you do not violate the regime of self-isolation in Russia, because higher authorities and the police are already authorized to draw up reports on these articles. It is best to have a special pass to exit the house, then there will be no problems.

Quarantine in Moscow: fines

I would also like to add more about fines duringquarantine in Moscow 2020. The Capital Code also provides for a number of measures to prevent leaving home without passes. This is evidenced by Article 3.18.1 of the Moscow Code of Administrative Offenses (CAO).

2.Failure by citizens to comply with the requirements of regulatory legal acts of the city of Moscow aimed at introducing and ensuring a high alert regime on the territory of the city of Moscow, including failure to ensure a self-isolation regime, if these actions (inaction) do not contain a criminal offense or do not entail administrative liability in accordance with the Russian Code Federation on administrative offenses, entails the imposition of an administrative fine on citizens in the amountfour thousand rubleth.

3. Repeated commission of an administrative offense provided for in parts 1 and 2 of this article shall entail the imposition of an administrative fine on citizens in the amountfive thousand rubles; on officials —from forty thousand to fifty thousand rubles; for legal entities — from three hundred thousand to five hundred thousand rubles.

4. Committing an administrative offense provided for in Part 2 of this article using a vehicle entails the imposition of an administrative fine on citizens in the amountfive thousand rubles.
